Services and Client Responsibilities

Welcome to TruePoint Accounting. By using our website (www.truepointaccounting.com) or engaging our services, you agree to the following Terms and Conditions. Please read them carefully before engaging with our services.

TruePoint Accounting provides bookkeeping services, including transaction recording, account reconciliation, and financial reporting, for small businesses and trades contractors.

TruePoint Accounting is not a CPA firm or Enrolled Agent, and does not provide tax preparation, tax advice, or business consulting services.

The specific scope of services for each client will be outlined in a separate engagement letter or agreement between TruePoint Accounting and the client. If anything in this page conflicts with a signed engagement letter, the engagement letter controls.

As our client, you are responsible for:

  • Providing accurate, complete, and timely information to allow us to perform our services
  • Reviewing and approving documents or reports we prepare before relying on them or submitting them elsewhere
  • Keeping your own copies of original source documents (receipts, invoices, bank statements, etc.)
  • Prompt payment of all fees as outlined in your engagement agreement

Failure to provide accurate information or pay fees on time may delay services or result in termination of services.

Fees, Payment, and Termination

All fees for services will be specified in your engagement agreement. Payment terms, including deposits, due dates, and accepted payment methods, are outlined in that agreement. We reserve the right to adjust fees with prior written notice to you.

Either party may terminate the engagement at any time by providing written notice. Upon termination, you are responsible for paying for all services rendered up to the termination date. See Section 4 for what happens to your data and records after termination.

Confidentiality and Privacy

We are committed to safeguarding your financial and personal information. Your data will not be shared with third parties except:

  • As required by law or court order
  • As necessary to perform the services you’ve engaged us for (for example, working with your bank on your behalf, with your authorization)
  • With service providers we use to deliver our services, described below

We use QuickBooks Online and other cloud-based tools to provide our services. These third-party providers maintain their own privacy policies and security practices governing how they handle data on their platforms. We choose tools we believe are reputable and secure, but we don’t control their infrastructure directly.

Client Data and Records Retention

You retain ownership of your original financial records and source documents at all times. We retain copies of the bookkeeping records we prepare on your behalf for 1 year following termination of services, after which they may be securely deleted.

Upon termination of our engagement, we will provide you with a copy of your bookkeeping records within 30 days of your written request, and will work with you to transition access to your QuickBooks Online account or other systems.

Limitation of Liability and Disclaimer of Warranties

TruePoint Accounting will perform services with reasonable care and in accordance with industry standards. We make no warranties, express or implied, about the accuracy, completeness, or reliability of any results beyond what reasonable care and industry-standard practices can provide.

We are not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim related to the services provided will not exceed the amount you paid us for the services giving rise to that claim.

Nothing in these Terms is intended to limit liability in ways not permitted under Florida law.

Dispute Resolution

Before filing a claim in court, both parties agree to attempt to resolve any dispute informally by contacting the other party in writing. If the dispute isn’t resolved within 30 days, either party may pursue available legal remedies.

General Provisions

These Terms and Conditions may be updated at any time, and changes take effect upon posting to our website. It is your responsibility to review these terms periodically.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the state or federal courts located in Palm Beach County, Florida.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
